  2. Collection, use and processing of personal data

Personal data are individual details that make a person directly or indirectly identifiable, such as a name or a postal address.

gernGuest collects such data exclusively within the scope permitted by law, or on the basis of your consent, or when you provide them to us voluntarily.

In the following cases, personal data may be collected, used and processed:

a) Access data

a.1) Server log files

gernGuest collects data each time the web offering is accessed (so-called server log files). The following data or categories of data may be collected:

Name of the page accessed

Date and time of access

Browser type and version

User’s operating system

Referrer URL (the previously visited page)

IP address

gernGuest uses these data exclusively for statistical purposes and for the technical optimization of the web offering.

a.2) CDN service (Content Delivery Network)

The CDN service is provided by our hosting provider via the technology partner Cloudflare, Inc., based in the USA. For the CDN service, content data are processed for the specific purpose of performance improvement on Cloudflare servers worldwide. In addition, Cloudflare, Inc., based in the USA, employs security and monitoring tools. For security and performance reasons, the following data are processed by Cloudflare, Inc. on Cloudflare servers:

Name of the page accessed

Date and time of access

Browser type and version

User’s operating system

Referrer URL (the previously visited page)

IP address

Cloudflare, Inc.’s privacy and security policies can be found here: https://www.cloudflare.com/privacyshield/

and Cloudflare, Inc.’s cookie policy can be found here: https://www.cloudflare.com/cookie-policy/ .

b) Contact

When contacting gernGuest, the user’s details are stored for the purpose of processing the inquiry and any follow-up questions. The user provides these data voluntarily.

c) Cookies

This website uses so-called cookies. Cookies are small text files that are stored on your device by the website via your browser. They serve to make your use of the website easier.

The cookies used for this website are generally valid only for the duration of your visit (“session cookies”). These session cookies are automatically deleted from your device when you leave the website. If you are offered the option of using a personal user account on the website, we also use a cookie that persists beyond the duration of your visit, in which the information required to log in to the website is stored to facilitate later access. This cookie has a lifespan of ninety days and is then automatically deleted.

The cookies used for this website do not contain viruses and do not damage your device. Personal data are not stored in the cookies used for this website.

If you wish to prevent the setting of cookies, all common browsers offer settings to block and delete cookies. However, blocking cookies may result in the web offering not being available or not being available in full.

d) Google Analytics with anonymization function

We use Google Analytics on our site, a web analytics service of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter “Google.” Google Analytics uses “cookies,” text files that are stored on your computer and enable an analysis of your use of the website.

The information generated by these cookies—such as the time, place and frequency of your website visits, including your IP address—is transmitted to Google in the USA and stored there.

We use Google Analytics on our website with the add-on “_gat._anonymizeIp”. In this case, your IP address is shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area and thereby anonymized.

Google will use this information to evaluate your use of our site, to compile reports on website activity for us, and to provide other services related to website and internet usage. Google may also transfer this information to third parties where required by law or where such third parties process the data on Google’s behalf.

According to Google, under no circumstances will Google associate your IP address with other data held by Google. You can prevent the installation of cookies by selecting the appropriate settings in your browser software; however, please note that in this case you may not be able to use all functions of our website to their full extent.

Furthermore, Google offers a deactivation add-on for the most common browsers, which gives you more control over which data Google collects about the websites you visit. The add-on informs Google Analytics’ JavaScript (ga.js) that no information about the website visit should be transmitted to Google Analytics. However, the Google Analytics browser add-on does not prevent information from being transmitted to us or to other web analytics services we may use. Further information about installing the browser add-on can be found at the following link: https://tools.google.com/dlpage/gaoptout?hl=de

Download and installation instructions can be found here.

Additionally, you can install the “Protect My Choices” browser extension, which deletes all cookies. More info and download here.

If you visit our site via a mobile device (smartphone or tablet), you must instead click this link to prevent future tracking by Google Analytics within this website. This is also an alternative to the above browser add-on. By clicking the link, an opt-out cookie is set in your browser that is valid only for this browser and this domain. If you delete the cookies in this browser, the opt-out cookie will also be deleted, so you will need to click the link again.

By using this website, you consent to the processing of data about you by Google in the manner described above and for the purpose stated above.

Further information regarding data protection and the functioning of Google Analytics can be found at http://www.google.com/analytics/terms/de.html.

e) Google Maps

This website uses the Google Maps product from Google Inc. By using this website, you consent to the collection, processing and use of the data collected automatically by Google Inc., its representatives and third parties.

You can find the terms of use for Google Maps at:

f) Embedded videos (YouTube)

We have embedded videos on our website that are technically provided by YouTube. YouTube is a service of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

We use the provider’s “extended data protection mode” to embed YouTube videos. In this mode, data are collected by the provider and a cookie is stored on your computer only when you click on the video. The controller within the meaning of data protection law is Google. Further information can be found in Google’s privacy policy.

If you want to ensure that no data about you are transmitted to YouTube, do not click on the embedded videos on our website.

g) Use of Facebook, Twitter and Google+ buttons

Our digital offering includes “social plug-in functions” for the networks Facebook, Twitter and Google+. To protect your privacy, we offer these social plug-ins as “2-click buttons.”

“Social plug-ins” are technologies that allow you as a user to make certain content known to members of social networks via a direct connection. We use a technical solution for integration that prevents data (e.g., IP address) from being transmitted to social networks such as Facebook when you open our website.

This means that the buttons of Facebook (operated by Facebook Inc., 1 Hacker Way, Menlo Park, California 94025, USA), Twitter (Twitter, Inc., 1355 Market Street, Suite 900, San Francisco, CA 94103, USA) and Google (Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA) are deactivated by default.

Only when you click the social plug-ins for the first time are they activated. The content of the plug-ins is transmitted directly from Facebook, Twitter and Google to your browser and integrated into our website by it.

With the second click of the social plug-ins, you can use the functions—such as “Recommend”—in full.

This activation is stored in your browser for up to eight weeks. You can deactivate the function at any time by clicking the individual buttons or by deleting the cookies in your browser.

g.1) Facebook button

gernGuest has no influence on the scope of data that Facebook collects using these plug-ins. However, we would still like to inform you about this as far as possible. Further details can also be found on Facebook’s pages.

When you visit our pages, a direct connection between your browser and the Facebook server is established via the plugin. Facebook thereby receives the information that you have visited our page with your IP address. If you click the Facebook “Like” button while you are logged into your Facebook account, you can link the contents of our pages to your Facebook profile. This allows Facebook to associate the visit to our pages with your user account. We point out that, as the provider of the pages, we have no knowledge of the content of the transmitted data or of their use by Facebook.

For the purpose and scope of data collection and the further processing and use of the data by Facebook, as well as the related rights and settings options for protecting users’ privacy, please refer to Facebook’s data policy: https://www.facebook.com/privacy/explanation

If you do not want Facebook to associate your visit to our pages with your Facebook user account, please log out of your Facebook account. You can also block Facebook social plug-ins with various add-ons for your browser.

g.2) Twitter button

Functions of the Twitter service are integrated into our pages. By using Twitter and the “Retweet” function, the websites you visit are linked to your Twitter account and made known to other users. In the process, data are also transmitted to Twitter. We point out that, as the provider of the pages, we have no knowledge of the content of the transmitted data or of their use by Twitter.

Further information can be found in Twitter’s privacy policy at https://twitter.com/de/privacy.

You can change your privacy settings on Twitter in the account settings at http://twitter.com/account/settings.

g.3) Google+ button

Our pages use functions of Google+.

With the Google+ button, you can publish information worldwide. Via the Google+ button, you and other users receive personalized content from Google and our partners. Google stores both the information that you have given a content a +1 and information about the page you viewed when clicking +1. Your +1s can be displayed as notices together with your profile name and your photo in Google services, such as in search results or in your Google profile, or elsewhere on websites and ads on the internet.

Google records information about your +1 activities to improve Google services for you and others. To use the Google+ button, you need a globally visible, public Google profile that must at least contain the name chosen for the profile. This name is used in all Google services. In some cases, this name can also replace another name that you used when sharing content via your Google account. The identity of your Google profile may be displayed to users who know your email address or have other identifying information about you.

Use of the collected information: In addition to the purposes explained above, the information you provide is used in accordance with the applicable Google privacy policies. Google may publish aggregated statistics about users’ +1 activities and may pass these on to users and partners, such as publishers, advertisers or connected websites.

gernGuest has no influence on the scope of data that Google collects using this button. For the purpose and scope of data collection and the further processing and use of the data by Google, as well as your rights in this regard and settings options to protect your privacy, users can refer to Google’s privacy notices for the “+1” button: http://www.google.com/policies/privacy/partners/

gernGuest does not transmit any personal data that you have entered on this website or that we have stored about you to Facebook, Twitter or Google.

  1. Security

To ensure that your data cannot be read by unauthorized persons during transmission, we encrypt our entire websites according to the current state of the art. You can recognize active encryption by the “https” in your browser’s address bar.

gernGuest takes the technical and organizational measures required by law to protect personal data against loss, destruction, manipulation and unauthorized access.

  1. Data retention period

Personal data are stored only as long as is necessary to achieve the purposes stated here, or as required by statutory retention periods. After the respective purpose ceases to apply or after the retention periods expire, the data are deleted or blocked in accordance with statutory provisions.

  2. Withdrawal, changes, rectification and updates

Upon request, the user has the right to obtain free information about his or her personal data stored by gernGuest. Furthermore, he or she has the right to demand the correction and deletion of his or her personal data. If data cannot be deleted due to retention obligations, they will be blocked until the retention obligation ceases to apply. The user can address all data protection inquiries by email to datenschutz@gernGuest.com or in writing to gernGuest, Datenschutz, Buchenring 25, 91341 Röttenbach.
